Terms of Service

By creating an account or using Holwa, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.

1. What Holwa does

Holwa is a technology service that helps users keep their own business records, manage stock and supplier activity, record amounts due and payments, purchase SMS reminder credits, and send messages that the user requests.

Holwa is not a lender, digital credit provider, bank, microfinance institution, debt collector, or financial adviser. We do not issue loans, guarantee repayment, or decide whether a debt is valid or enforceable.

2. Your account

You must provide accurate account information, protect your sign-in credentials, and promptly tell us about suspected unauthorized use. If you act for a business, you confirm that you may accept these Terms for that business.

3. Your data and lawful use

You retain your rights in the data you lawfully enter. You give Holwa the limited permission needed to host, process, display, transmit, secure, and back up that data solely to provide and improve the service, support you, and meet legal obligations.

You are responsible for the accuracy of records you enter and for having a lawful basis to use another person’s information. A record in Holwa is not proof that a transaction occurred, that a debt exists, or that a person owes money.

4. SMS and payment credits

You may use purchased message credits to request SMS reminders or order-related messages. You must only message recipients you are entitled to contact and must not send spam, threats, harassment, deceptive content, or unlawful collection messages. Delivery depends on telecommunications providers and is not guaranteed.

M-Pesa purchases are handled through Safaricom’s payment flow. You must review the amount before authorising the M-Pesa prompt. Credits are added only after a confirmed payment. Credits already used for delivered message attempts are not refundable except where required by law or where we confirm a service error.

5. Prohibited use

Do not misuse Holwa, access another person’s account, enter knowingly false or unlawful information, violate privacy rights, send abusive or unlawful messages, attempt to bypass security, introduce malicious code, scrape or reverse engineer the service except where law permits, or use Holwa to provide regulated financial services without the required authorisation.

6. Availability, suspension, and account deletion

We work to keep Holwa available but do not promise uninterrupted operation. We may suspend or limit access when reasonably necessary for security, legal compliance, suspected fraud, abuse, or a material breach of these Terms. You can request account deletion at https://hol-wa.com/delete-account; the Privacy Policy explains what is deleted and limited retention exceptions.

7. Disclaimers and liability

Holwa is provided on an "as available" basis. We do not promise that user-entered records are accurate, that an SMS will arrive, that a customer will pay, or that a business outcome will result. To the extent permitted by law, Holwa is not liable for indirect, incidental, special, consequential, or lost-profit damages. Nothing excludes liability that cannot legally be excluded.

8. Changes, law, and contact
